Hi,

So I have a few debts I cannot pay, one debt (was an unsecured bank loan with Comm Bank) which has gone to court and the decision has been made that they can garnish my wages.

My employer has received an email from the creditor advising them of this and they have now been instructed to pay them some of my wages, I've now been paid my first week of wage garnishment and am struggling.

If I go bankrupt now, will this wipe and put an immediate stop to this wage garnishment? Even though the court has ordered this?

In what respect are you struggling?
Ask yourself - hard - what else you can do without in order to meet the order?

There are budgeting/ personal money management education services available in most states.

Understand this - personal bankruptcy is not an easy out.

Struggling as in I will be in the minus - no extravagant lifestyle by any means.

Bankruptcy is obviously the only option here, no assets either but I would just like to get 100% confirmation bankruptcy will put a stop to a court ordered wage garnishment..

Is the debt to the ATO, or to a non-government entity?
