We all know that if you're backing out of a space in a car park and hit a car driving past, you are automatically at fault. But, what if you're already two thirds of the way out of the space when it happens?

At what point, does it cease to be a case of your own negligence and become a case of deliberate reckless driving on the part of the other motorist?

You would have to look at the entire circumstances to try and apportion blame. The police may view it as a civil case and not want to get involved but if they deem carelessness then charges may follow.

You have to give way, but if your already half way through entering the main roadway before the vehicle on the main road came into view, then they should give way.

This is an issue for trucks, being very slow, often they will be exiting a driveway and block main road traffic and people tooting horns.... but here is the thing, if the truck started his maneuver before those cars came along, they should give way and be patient. All to often though, trucks in driveways see you coming 'before' starting their entry to the road, but just dont give a s**t and pull in front of you and nearly run you off the road and then lie and pretend that their driving a slow truck so its my fault... No, you saw me coming """""before"""" starting your maneuver, so 'YOUR' the arsehole in the wrong and you know it.
