Righto,

There's a Civil Aviation Safety Regulation (CASR) which regulates the operation of a model aircraft at night. The regulation requires:

101.390 Operating model aircraft at night

(1) A person may operate a model aircraft at night only in accordance with the written procedures of an approved aviation administration organisation.

Penalty: 25 penalty units.

(2) An offence against subregulation (1) is an offence of strict liability.

Note: For strict liability, see section 6.1 of the Criminal Code.

The "written procedures of an approved aviation administration organisation" regarding this particular regulation can be found here:

My question is: Can a person , "Joe public", not a member of any association,group,and does not intend to be a member of any such approved aviation administration organisation, under Australian Law simply a person who has purchased a toy aeroplane operate the model at night using the document above as the overarching regulation requires?

I would appreciate the 'learned forums' opinion on the matter.
