My brother is going through a break up. He has a credit card which he owes money on but the items that are owing he left in the house with his ex and kids. My question is, can he take those items if he is solely paying off the credit card or could child support take into account these items?

My experience with child support is no, they will not take this into account. It will need to be confirmed by the receiving parent and if it means they loose out, they generally fall on "it was a gift".

There is a post similar to this one in the "property law forum" (excluding the child support part). Maybe have a look through there if your brother is looking at either getting his stuff back or getting some sort of help with payments?
