I was in a hospital waiting room last night when I witnessed a security guard (private firm) physically take a bag of cannabis from a man in the waiting room. The man argued it was his property and asked for it back but the guard refused. It was then given to hospital staff who locked it away.

Did the guard or the hospital have the right to do this?

Tricky area, however I don't imagine the patient would be too eager to call Police to report his drugs stolen. There is an interesting case Commissioner of Taxation v La Rosa where a drug dealer was able to claim his stolen drugs as a deduction for the purposes of income tax. I can't see why he couldn't technically claim the drugs as his, as stupid as that would be.
