Hi Everyone,

My husband's ex-wife's father is constantly sending emails of a derogatory nature to my husband, stating some horrible things about my husband and myself. He is also using the "cc" option to include his daughter in the conversation. Can this be a case for defamation?

This person lives in Scotland and we live in QLD Australia. I do not know where to begin this process. I have all the emails as well as good old Facebook screenshots of further derogatory comments.

Any advice would be helpful.

Can this be a case for defamation?

Yes. Though defamation will still need to be proven, and he must not have an adequate defence.

If you win in Australia, you then need to apply for enforcement of the judgement in the UK. I know nothing about reciprocity with the UK so can't explain how that part works.
