Hi, I just want to know, I am applying for divorce application and want to know if my ex can claim any of my current partner's property because I live with her. I don't own any of the property and have been living with her for 10 months

Thanks in advance

Hi MOZINOZ72,

No. With regard to property settlement between ex spouses - these are either negotiated between you - or ordered by the court. A court can only award the settlement from the property pool that each ex partner had at the time the relationship was ended and in certain cases what they acquired after that. Unless you tried to get rid of your property by selling it at an undervalue or transferring it to your current spouse to avoid your ex getting her hands on it, then no the court won't take property from your current spouse to give to your ex.

Read this article on how a court will arrive at a property settlement.
