I own a unit (duplex unit) with one roof, one house split half.

The gable roof wood has rotted and needs to be replaced and despite multiple phone calls and emails they don't respond or don't seem care. Every time they ask to come with quote from qualified professional and the promise they will get back but they never do.

Its at a point where there are holes in the roof which could effect my side of the property.

What are my options in property law? If something goes wrong, can take them to court for damages?

Does the duplex unit have common property, is there a body corporate?

If the damage is solely on his property, but affects your property, then you probably need court/VCAT orders allowing access and repairs to be done, with the other owner to pay costs.
