Good evening all,

Could somebody be so kind to clarify whether a 60I certificate needs to be issued for an amended initiating application for parenting orders (interim and final orders sought)?

My understanding is that it is exempt in this case. But I have been advised otherwise.

TIA

Depends.

There are various exemptions that are available but without knowing your details it is not possible to say. Something like this is best asked of a lawyer who has all the facts to look at before providing advice.

An amended initiating application? So there are already proceedings on foot?

If so, you don't need another s60I certificate, you just need to file the amended initiating application with a supporting affidavit.
