Baby 11months old. Woman says my partner is the father. My partner and I have never denied that he isn’t. Problem is she won’t Allow him to meet the baby or spend time with him. Sends photos all the time.. tells him how the baby is going.. how does my partner go about getting a DNA test done is he’s not allowed to even see the baby.

He’d have to file for parenting orders to have some formal way of ensuring it gets done, but before we get to talking about court (because it may not even be necessary), what outcome would be his ideal? Does dad want a relationship with the child if he is the father? Has mum filed an application for a child support assessment?

Thanks. He does want a relationship with the child if he is the biological father. He is not listed on the birth certificate so I don’t think she has made a child support assessment.

Great, good to hear. First step is to contact a mediation service (like Legal Aid or Relationships Australia) to organise mediation. They’ll do the legwork of contacting her about it and inviting her to the table.

It’ll give your partner an opportunity to meet with the mother in a controlled environment and see if they can get an agreement in place to get a DNA test completed and, if positive, start being involved in the child’s life.

If mediation fails, then he can seek parenting orders through court, but maybe get mediation done first and see how it goes. If it doesn’t pan out, come back and we can give you some more guidance.
