I bought a used car on Friday the dealer came with me for the test drive and cut the drive short car seemed fine so I didn't think much of it.
Signed paper work drove 50 kms car broke down major engine problems. Cost me $ 550 to tow back to dealer who is not to helpfully.
Where do I stand

A start would be..,

State of purchase. Price you paid. Type of vehicle, ie, commercial, 4wd, passenger? Standard contract or conditions

Nsw paid $5150 cash down from $5900 eft toyota kluger SUV I think it's just a standard dealers contract that states it's a used car. Bought for my wife as we are 400kms from home at children's hospital caring for our daughter that has cancer so I can try n go home occasionally to work as we have been here for 3 months already with no income. They tried to replace the SUV with a small Honda civic with an extra 20 odd thousand k's with hail damage which I refused. They said they will look at car and repair on Monday which I can't see how they can do considering the nature of the breakdown

So no dealer finance then?....

If the car had done 160K Km's or less & the dealer arranged finance (loan) then you MAY have been within the cooling off period since you bought it Friday... If that's not the case, then you may have to rely on their word to repair.... Fair trading may also be able assist if you give them a call Monday & tell them your situation, they may have a suggestion regarding the towing bill as well...& given your unfortunate circumstances, I wonder if the dealer may offer you a free or low cost loan car whilst the repairs are being carried out

They gave me the civic as the loan car but we are to scared to drive it as I had to sign a form saying I'm liable for the car and traffic infringements which I am happy with but also for anything mechanical which freaks me out as the car they sold me was meant to be sound and lasted less than an hour.
