Hi all,

Ive got an application for interim and final orders in relation to my son and stepdaughter.

The stepdaughter's biological father has received legal aide and is seeking to be added as a party. He has no orders in place and no contact with his daughter.

Does this only give him opportunity to say he doesnt want his daughter to spend time with me?

Im assuming if he wants to see his daughter that he'll have to lodge a seperate application at some point?

Dont get me wrong, im all for a dad seeing his child but i just dont want my case dragged out further by having magistrate spend half our court time on the fathers affidavit, his requests for orders etc.

The biological parents to a subject child in parenting matters is always involved in proceedings - whether they choose to actively participate or not, they are still listed as a respondent.

Dad may seek orders of his own - like time with the child, etc. - or he may just be included as part of formalities. It’s best to wait and see what he files before worrying too much about it.
