We are a small family owned business who provides a product into the market place via retail outlets.

We offer customer support to our customers 7 days a week up to 6pm.

The position normally operates out of an office between 9am and 6pm Mon/Friday and Weekends I normally take the customer service line.

On the weekend we are lucky to get 3 to 8 calls maximum where customer need customer support, Calls can vary from 5 minutes to 15 minutes.

Is it legal to have a staff member on call from 9am to 6pm for the weekend and pay them an on call bonus of $220 if they take the phone lines for the weekend? They would be given a company mobile phone and be expected to answer the customer support line if it rings.

If not what am I expected to pay for something like that? and would there need to be a special agreement written up?

What Modern Award covers that work?

What is in the contract of employment about 'on-call duties'?

If you do not know, call the Fair Work Ombudsman and ask them.
