Hi.

My wife had an affair a while ago with a guy who is also married with a child. She ended the affair and we are trying to work things out along with a therapist. The guy's wife has no idea of the whole thing and the therapist has advised us against disclosing the matter voluntarily to her.

The issue that I have is that the guy had made a couple of short sex videos on his GoPro. He also had a bunch of images of a sexual nature of her. He's assured her that he's deleted the photos and videos which apparently were on an encrypted USB.

Is there anything that she or I could do get a hold of that USB legally under Australian Law? Or is there anything that we can do to make sure he's deleted it or make it clear to him that he can get into legal issues if he continues to keep or release the images/ videos online or something?

Mate, I feel for you. He will delete them. Why? He is scared the missus will find out. He could delete them but keep a copy.

Sure you could spend $1000 or more getting a solicitor to write to him. Spend that money on a holiday to Bali with your wife...

It is a criminal offence in Vic to take and distribute sexual images of someone without their knowledge and agreement.

Maybe a quiet work telling him they'd better be deleted or he'll face criminal charges.

It is even illegal to threaten to send/distribute sexual images/video.

Hey Rod. Thanks for the help. I really appreciate that. Puts my mind at ease a little bit.

When I confronted him he said he'd deleted it all (my wife was going through a lot of emotional distress and he claims that he deleted it all hoping she would start to feel better).

I really wanted to beat the s**t out of him when I confronted him, but my friend and wife insisted that I not do anything since he could press charges against me.

Wish there was something else I could do to get back at him.

1. Tell his wife.
2. Do nothing further. The universe will deal with them both.

Tell his wife. To what end? I bit of revenge... Nah... And that could end badly.
I like TIm's second suggestion - let the universe sort it.

I would've asked.. no demanded the guy give up the videos & images under threat of telling his wife.... Then when we had them, tell him if there is as much as one image of this woman from these vids & stills shows up anywhere, ever, a copy will go straight to the cops & another to his wife
