Beer money. Pay it. Much cheaper and smarter than any other option.
As far as superannuation goes the answer is no. Well kind of. There is a 12 month window to apply to court for assets that includes a super split. She can seek an exemption but would need a good reason. So while not a definitive NO. It is pretty close to a definite no.

my son and his now ex separated 4 years ago , they have a son he is now 6- my son has taken along time to get around to changing the mortgage into his name only and taking her name of - he is able to refinance so that is good

But is the house title in just your sons name or both ?
