Hello,

I have recently been served with a claim document by Pioneer credit solutions, who have apparently bought my debt from ING direct. I had sold my house in March 2018 due to financial hardship, and could no longer keep up repayments. There was a shortfall on the sale which was $52,935.86.
Pioneer credit has bought the debt and is now threatening to escalate the legal process if I do not pay in full. I am currently on a low wage but have managed to gain more hours, but cannot meet their demand.
I have offered to pay what I can fortnightly, but they have rejected the offer and the balance outstanding to our client as at 10 May 2019 amounts to $55,431.59 and is continuing to accrue interest and costs. Can they do that?

Apart from the claim statement document which was sent to me in person, they haven't provided any other documents to me.

They propose:
1. A lump sum payment of $40,000.00 (“the settlement sum”) paid directly to our client by Friday, 17 May 2019;
2.Proof of payment is to be sent to the writer by close of business on Friday, 17 May 2019 (AEST); and
3. Upon receipt of the settlement sum our client agrees to cease all legal action and subsequently, close their file.

What options are available to me? I would appreciate all the helpful advice you can give and I thank you all in advance.

If it’s a statement of claim u need to lodge a notice of defence urgently they will get judgement if u don’t this

We have written to the board of directors of pioneer there are 4 of them they are all based in wa

They really don’t respect the law or the asic debt collection guidelines
