Hi Kenny.

From my experience and from various recent family court decisions you may be successful arguing that as wastage. If you are able to show a paper trail to the court then your argument will be much stronger. I always recommend to my clients that they be prepared if going on a forensic exercise that they too may be examined and sometimes they may have a wastage in the relationship aswell which may offset the other wastage. That being said, generally money spent on drugs, gambling, strippers or any particular addiction that has reduced the final asset pool considerably, will be wastage.

does it make a difference if the wastage has been during the marriage and not after separation/divorce
