Hello

I have about 7 old unregistered rusty wrecks and an unregistered Winnebago on my property from a gentlemen who was leaving them here for storage. He was supposed to pay a weekly storage fee. This was over a year ago. Since then we have not seen him and he has made no payments, I had contacted him about 10 months ago regarding the storage fee money and he kept giving excuses he was working out of the state. I said you can transfer the money into the bank account etc, he just kept giving excuses. Have not seen nor heard from him since about 10 months ago. Since then his phone number has been disconnected, i have no address either. I would really like to be rid of these wrecks off my property. I have researched about bailment etc but it seems to be more towards businesses and registered cars. What can i do, i would like to see if i could sell them to recover some of the money he owes.

Check your legal standing under the Abandoned Goods Act. If there is no written contract and he cannot be contacted, I would say you are within your rights to dispose of them after a certain amount of time.

QLD doesn't have an "Abandoned Goods Act". It does have a "Disposal of Uncollected Goods Act" but that only applies to businesses.

In a non-business situation, you can't dispose of the goods without the agreement of the owner or a court order.
