in circumstances where a colleague has left their personal fb logged on and a messenger conversation (with another colleague) open on the work computer, and the conversation is seen and is defamatory, nasty and bullying and about the reader, is it illegal for the person who found the messages to read them?

If it was a person's private PC, yes.

If it is a employer owned PC did you have a legitimate work related reason for using the computer?

Does your workplace have any restrictions on accessing personal accounts while at work?

What is your work's privacy policy/computer use policy?

BTW, did you take a photo of the messages?

OK, so it's not clearly illegal. Still maybe depending on intention and what state you are in. Each state has different laws.

Re: Photos. Taking photographs of the messages on the PC screen using a mobile.
