I run a waste transfer station in QLD My employer insists I should be paid under the level one security services award . The AW union have had no resolution after three months . I have now contacted the fair work comission who want to arange a mediation. To me I should be paid under the waste management award. I feel totaly overwelmed and unable to negotiate my self , what should I do

Ask your union for help or at a minimum a lawyer who may be able to help you.

Errrr, an employer cannot just pick a random award that does not apply to the work you are doing?? This would also give your employer an unfair advantage over competitors in the industry who pay the correct award.

Do you have your letter of employment? Or employment contract?

Also Make detailed notes of all the duties you are expected to carry out in your role. If you have any correspondence from your employer giving you tasks to do, this is all supporting evidence.

Keep it ready for the Fair work ombudsman.

Very good , thank you , the unfair advantage is one thing I never thought of . Contractors have to tender for the rights so if their wage bill is lower they can submit a lower tender ! Brilliant

thanks Clancy, Fair work is setting up a mediation , I dont have a letter of employment , have been casual for three and a half years which is another issue and I do have a daily task sheet
