I'm 22 years of age and I'm an Australian citizen living in Sydney. My partner has been living in Australia for about 18 years and is currently serving time in prison. He has been trying to get his visa back from the immigration but the immigration he connected within the past few weeks recently declined his appeal. He will get sent back to New Zealand after he finishes serving time in prison which ends in January 2018. I was just wondering if there is anything I can do? or what are the options?. I'm not sure and I don't really understand how the process works but I just wanted to know if there is a way to do whatever is possible to get his visa back. If you could send me information about this subject on what to do please let me know. Thank you.

I would expect that the appeal process can be used again, the problem being that unless you do something different you will most likely get the same outcome. Are you married to your partner? Do you have children together? Do you own property together? I'm just suggesting that if you can paint a picture of a life together in Australia, that might be a step closer to getting it approved.

Thanks for your response! I am not married to my partner. We don't have children together and we don't own a property/ never lived together. We've been in a relationship together for over a year now tho but if I was to call the immigration would it be a waste of time? or is there an option like what if me and my partner were to get married?

Hi Maileem,
If you call I don't imagine it would be of any benefit. I still think your partner could apply to appeal the decision again, but unless he does something different he will probably have the same outcome.
