No, not necessarily. Some parents are their own worst enemy. You said she has a current VRO against you. Whether the children are named as protected persons or not does not change the fact that this form is mandatory.

Did you admit in the VRO trial that you were are a drug dealer?

An ICL will likely be assigned to your case and a family report undertaken in the course of proceedings. The report writer makes recommendations the Judge makes the decisions.

IMO, at this time, you would be better advised to concentrate your energies on how you can effectively respond to the allegations being made by the mother, as well as the arguments you can raise and evidence you can provide to do this.

No, I never said I was a drug dealer.

Yes, I was hoping that the court might appoint an ICL and get an interdependent psychologists report done. That way it might show that she has been lying and vindictive. The allegations she has made are hard to prove or disprove it's her say against mine.

Just a horrible place to be in.

Even in The Family Court of WA where they do things a little differently, to say the least, a Notice of Risk needs to be filed if allegations of family violence or child abuse or risk thereof is made. She has a VRO. In other states it is mandatory for all parties to file this form. Each Court has their own form but they are all for the same purpose.

A rational, caring parent who can show the Court that they have their children's best interests in mind and can raise concise and logical arguments, will get much further than one who is sidetracked and spends too much time complaining about their ex. The court and its processes can be very long and exhausting but you will get through it.

You are not the first parent to be ordered supervised time in the interim and you will not be the last. Stay focussed on the reason you are there, your kids! There is an end even if it does look a million miles away right now.

I have no choice other than to fight on for my 4 kids and I will fight for them all the way. One of the bigger than all of us situations is that this whole VRO/family court/lawyers/CSA is an industry in itself that don't care in the least about the children and the family. It's all about the money for most of them and the others its about keeping jobs.

What this discussing system/industry is doing amounts to nothing less than child abuse. Please tell me I'm wrong.

How can any caring system allow one parent to have complete control over the other with being able to use one of the systems tools and remove that parent from their children for 6 months or more before a chance to defend with no proof?

If that's not child abuse what is?

I have been in contact with politicians and heads of government departments and have had calls back from the ones I have ruffled feathers with already. I'm apparently going to receive a call from the attorney generals office shortly so I can discuss my concerns with them.

Looking forward to that.

3 separated men a day is the average suicide rate. Why? Where are their children? I can't see mine at Christmas because the family court said it's not my weekend.

Well WTF!!

Do we lie down and put up with this and say, "Well, we can't change it, or do we do something about it?

However, while I do not disagree with you that there are fundamental flaws within the current system, and that legal costs are prohibitive for many litigants (which seems cruel given the area of law), none of this is going to help you with your current matter.

I have always been a proactive person and to see the injustice in this system/industry just makes me as mad as hell. I was always of the stupid belief that it was a justice system and if you told the truth and never did the wrong thing, you would be the one that was looked after. I couldn't have been more wrong and so disappointed and let down. I just felt so betrayed by what I always thought was there to protect me and the innocent.

I wasn't thinking of my situation and I know it's to late for me, but I think I still have a long fight ahead of me and I'm more than happy and able to rattle some of the ivory towers along the way.

If I can bring some notice to this horrible system/industry and show how it can be manipulated by vexatious people at the expense of our beautiful children and perhaps save some poor buggers life along the way I damn well will.
