Hello,

I am an international student. I am married to a guy I thought he loved me but he was just faking. He is on my dependent visa and I do not want him to stay as he used me. He has his girlfriend and he said that he didn't ever love me. All of those were an act created just so he could come here.

I want him to go out from Australia as he misused the right to bring partner here. I just want to be rid of this guy as we are no longer in any relationship.

Please help me with Immigration Law.

Hi Rekha, I'm sorry to hear of your situation. However you do not have the right to cancel your ex husband's partner or dependant visa on the Department of Immigration and Citizenship can cancel a visa. If your relationship has ended, you must notify DIAC. You will also be asked to withdraw your partner visa sponsorship. There are certain circumstances where an applicant can still be granted the permanent partner visa notwithstanding that the relationship has ended.

My sponsorship was also withdrawn by my husband last Nov & we both came to India.I was ashamed and embarrassed to tell my parents.This Feb my spouse visa was also cancelled as I couldn't provide proofs of marriage reconciliation as required by immi.

I feel cheated as this was unexpected.But my husband is staying in India only with parents since then.He hasn't gone for any work,I haven't held a job either since grad.So getting a job has been difficult for me.He hasn't provided for any maintenance also.He is an Australian citizen now.I phoned to police Nov 2015 and asked them to convince him to attend marriage counselling

I made sure no charge was files and he agreed to comply to attend counsel.But his family took over and now I am the dumb victim again. Truly,both me and husband are innocent and want to genuinely lead a good life together but his parents interfere a lot and that's why I sought counselling.We progressed initially after this but stopped seeing the psychologist when his mother interfered.He hasn't talked with me for 8 months now.

I didn't have opportunity to contest my case till now. But unfortunately now, my visa has been permanently cancelled.
