You will need to wait until 14 clear days after the probate notice is published in both the newspaper and the Queensland Law Reporter before you can file the application for a Grant of Probate.
A Grant of Probate usually takes around 4 weeks after you file your probate application. This is on the basis that there were no requisitions to the probate application requiring further information or corrections. You will receive the official Grant of Probate via post.
Current probate fees for filing an application for a Grant of Probate in Queensland are $637.40. (Government Concession Card holders may be eligible for a reduced filing fee of $116.20.)
The Supreme Court Registry accepts payment of the filing fee by credit card, cheque and cash if in person.
Supreme Court registries that deal with probate are located in Brisbane, Rockhampton, Townsville and Cairns. The Brisbane Supreme Court registry is located at 415 George Street, Brisbane QLD 4000.
You can file a probate application at the Supreme Court registry either in person, or by post. The postal address for the Brisbane Supreme Court registry is PO Box 15167, City East QLD 4002.
