I’m in a middle of a property settlement following a divorce. The settlement is ongoing now for the last 14 months and my ex husband is careless about it. We are Company Directors in the Company that I have been running since it was purchased in July 2005. Currently looking at options.
Question 1: Should I resign as a Director of the Company, am I still entitled to eventual property settlement including my share (half) of the Company?
Question 2: Should I resign as a Director, will I be free of all Company liabilities?

It might be wise to get personalised advice from your lawyer who's managing your property settlement.
As a director, you still remain liable for any liability under the Corporations Act 2001 (Cth) that was incurred or any offences that were committed by you/the company while your were a director of the company.
